Dear District 2 Neighbor,
On September 17, 2009 the City Council voted to rezone the property at 301 Yucca Street from a "MF-33" Multi-Family District to a "C-3 NAS" General Commercial District Non-Alcoholic Sales with a Specific Use Authorization for a Correctional Facility (Transitional Home) against both City Staff and my recommendation for denial. Since then, a group of District 2 residents have been working to challenge this decision. As a result a court case has been filed against the City of San Antonio. Please see the message below:
A coalition of citizens from the East side filed suit Monday against the City in state district court seeking a temporary restraining order (TRO) enjoining the enforcement of the District 2 Transitional Home facility zoning change approved by City Council on September 17. The matter was sent to Judge Andy Mireles. Several plaintiffs testified that they believe the facility will devalue their property and endanger the neighborhood. Judge Mireles expressed his opinion that plaintiffs had met the minimum burden for establishing a need for a TRO. He enjoined the City from "enforcing" the zoning ordinance and "suspended" it pending a hearing on Temporary Injunction set for Thursday, October 15, 2009 at 9:00 a.m.. Counsel for Crosspoint (the correctional facility), Bobby Perez, was present at the hearing. He indicated that he will file a Plea in Intervention so his client's interests can be heard on Thursday. He also indicated that the current owners will intervene in the case.
This case will be held on the 4th floor of the Bexar County Courthouse at 300 Dolorosa Street and is a public hearing for those who are interested in attending. Please feel free to contact my office at 207-7278 for any questions.
